Personal Service & Performance Contracts
WKU Purchasing manages Personal Service Contracts, Memorandums of Agreement (MOA), and Performance Contracts in accordance with Kentucky law and University policy. The information below outlines the purpose and requirements for each contract type, along with resources and training to help you through the process.
Personal Service Contracts
A Personal Service Contract is an agreement with an individual, firm, partnership, or corporation to perform services requiring professional skill or judgment for a specified period and price.
Governed by KRS 45A.690 to 45A.725. The University's policy governing Personal Service Contracts is established by state law.

Memorandums of Agreement (MOA)
MOAs are a type of Personal Service Contract used only between WKU and other in-state public agencies (such as universities, colleges, local education districts, the Commonwealth of Kentucky, or local governments).
Performance Contracts
Performance Contracts are used for visiting speakers, expert witnesses, and performing artists. These require:
- Signature of the University’s Chief Financial Officer.
- A signed, completed W-9 form from the payee (indicating business type).
- An online requisition submitted to Purchasing.
- A Determination Status form if the payee is an individual.
